DMK Challenges Waqf Amendment Act in Supreme Court

Break10: The Dravida Munnetra Kazhagam (DMK), today, filed a petition in the Supreme Court contesting the constitutional validity of the Waqf Amendment Act (2025). The party argues that the Act infringes upon the fundamental rights of Muslims, particularly affecting the autonomy of Waqf properties.

DMK deputy general secretary and member of Parliament A Raja, who also served on the joint parliamentary committee reviewing the bill, filed the petition. He highlighted that despite objections raised during parliamentary discussions, the amendments were passed without adequate consideration. The DMK claims that the Act adversely impacts the rights of approximately 50 lakh Muslims in Tamil Nadu and more than 20 crore nationwide.

Earlier on 27 March, Tamil Nadu chief minister Muthuvel Karunanidhi (MK) Stalin moved a resolution in the state Assembly urging the Union government to withdraw the amendment. He labelled it as “unconstitutional” and detrimental to the Muslim minority community’s interests.

The Waqf Amendment Act (2025), passed in Parliament on 3 April after extensive debates, introduces significant changes to the management of Waqf properties. Critics, including DMK and other Muslim organizations, argue that the Act grants excessive control to the government and includes non-Muslims in the boards. The critics believe that this undermines the religious and charitable purposes of the properties.

The apex court’s examination of the petition will be pivotal in determining the balance between government oversight and the protection of minority rights concerning Waqf properties.
